Welcome to SugarInspector (the "App"). These Terms of Service ("Terms") govern your access to and use of the SugarInspector mobile application. Please read these Terms carefully before using the App.

1. Acceptance of Terms

By accessing or using SugarCheck, you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. Description of Service

SugarCheck is a mobile application that allows users to:

• Scan product labels using their device's camera
• Analyze and detect added sugar content in products
• View scan history and track sugar consumption
• Access educational information about added sugars

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

4. User Accounts

4.1 Account Creation

To use certain features of the App, you must create an account. You can create an account by:

• Signing up with your email address
• Signing in with your Google account

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. Free Usage and Subscriptions

5.1 Free Tier

The App offers a free tier with limited functionality:

• Free users can perform up to 5 scans
• After reaching the limit, a subscription is required for additional scans

5.2 Subscriptions

We offer premium subscriptions that provide:

• Unlimited scans
• Access to full scan history
• Additional features and content

5.3 Subscription Terms

• Subscriptions are billed monthly or annually
• Subscriptions automatically renew unless cancelled
• You can cancel your subscription at any time through your Apple App Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods

5.4 Payment

All payments are processed through the Apple App Store. By purchasing a subscription, you agree to Apple's payment terms and conditions.

6. User Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to access the App without permission
• Interfere with or disrupt the App or servers
• Impersonate any person or entity
• Collect or harvest information about other users

7. Intellectual Property

7.1 Our Rights

The App and its original content, features, and functionality are owned by SugarInspector and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain ownership of any photos or content you upload to the App. By uploading content, you grant us a license to:

• Use, store, and process your content to provide the App's services
• Analyze your photos to provide scan results
• Store your scan history in your account

8.2 Service Availability

We do not guarantee that:

• The App will be available at all times
• The App will be error-free or uninterrupted
• Scan results will be completely accurate
• The App will meet your specific requirements

8.3 Third-Party Content

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party services.

9. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App or subscription in the past 12 months
• We are not responsible for any decisions made based on information provided by the App
• We are not liable for any loss or damage resulting from your use of the App

You agree to indemnify and hold harmless SugarCheck, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or transmit through the App

11. Termination

11.1 By You

You may stop using the App at any time by:

• Deleting the App from your device
• Deactivating your account through the App settings
• Cancelling your subscription (if applicable)

11.2 By Us

We may terminate or suspend your access to the App immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees (if applicable)
• Otherwise breach these Terms

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through:

1. Good faith negotiation between the parties
2. If negotiation fails, binding arbitration in accordance with applicable arbitration rules
3. If arbitration is not available, through appropriate legal channels

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending you a notification through the App (for significant changes)

Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SugarInspector regarding your use of the App.

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and SugarInspector, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support or maintenance
• In case of App failure, you may notify Apple for a refund
• Apple is a third-party beneficiary of these Terms
